Terms and Conditions & Right of Withdrawal

1. Scope

These terms and conditions apply to all sales from Virginie Pässler, trading as „LA VEE“ (hereinafter LA VEE), to consumers. A consumer is a natural person who is acting outside the scope of an economic activity (trade, business, self-employment).

3. Contract Conclusion

The presentation of the products in the online store do not constitute a legally binding offer, but rather an invitation to place an order.

By clicking the button that completes the electronic order process after putting your chosen product(s) in the virtual shopping cart and after going through the various steps of the ordering process, represents a legally binding offer from you to buy the products contained in the shopping cart. Your sales agreement comes into effect when LA VEE accepts your order with an order confirmation email after receipt of your order.

4. Right of Withdrawal (statutory cooling of period)

In the EU consumers have a right of withdrawal for distance and off-premises contracts as outlined below. A consumer is a natural person who is acting outside the scope of an economic activity (trade, business, self-employment):

If you wish exercise your right of withdrawal under section 4.1, you will have to pay for the return shipping charges.

The right of withdrawal encompasses the following regulations

You have the right to withdraw from the contract within 14 days without giving any reasons.

The time period starts on the day that you, or a third party named by you that is not the shipping provider, received the purchased product(s).

In order to exercise your right to withdraw, you need to inform us [LA VEE, Virginie Pässler, Rumfordstr. 38, DE-80469 Munich, (+49) 89 37012810,] and clearly state your decision to withdraw from this contract (e.g. by letter, by email or by telephone).

It is necessary that you send off your notification of withdrawal before the 14-day deadline.

Withdrawal Policy
If you withdraw from this contract we will refund the purchase price including shipping charges (except additional shipping charges if you specifically requested non-standard shipping). We will do this without delay and latest within 14 days of receipt of your withdrawal notification. We will refund you through the same payment type you used for the purchase, unless you explicitly agreed something else with us. We will never charge you any fees for the refund. We can withhold the refund until we have received the returns or until you have presented us with proof of the return shipment, depending on which is first.

You have to return the product(s) without delay and latest within 14 days after informing us of your withdrawal. It is necessary that you post the product(s) before the end of the 14 days deadline.

You will have to pay for the return shipping charges.

The consumer shall only be liable for any diminished value of the goods resulting from the handling other than what is necessary to check the quality, properties and functionality of the product.

Exemptions and Limitations to the Right of Withdrawal
The right of withdrawal does not apply to contracts for goods made to order (e.g. made to order hats, clearly personalised goods), that means goods that are not ready-made and which are made according to specific requirements or features chosen by the consumer.

The right of withdrawal does not apply to consumers who at the time the sales contract was made, were not a citizen of a member state of the European Union and who did have a sole residency and delivery address outside of the European Union .

5. Pricing and Shipping Cost

Prices stated on the product pages include tax and any other price components.

Delivery charges will be added to your order. For deliveries within Germany the charge is €6 per order and for deliveries within the European Union it is €16 per order. You can find a link to the delivery charges on each product page and these will also be clearly stated at check out.

Deliveries to countries outside of the European Union may be subject to additional costs that are not the responsibility of the seller but of the customer. These are for example transaction fees (e.g. fees for wire transfers, exchange fees) or import fees, local taxes and duties. Such additional costs may also be incurred if the delivery is not to a country outside of the European Union but the customer makes the payment from a country outside of the European Union.

6. Delivery

We ship to Germany and the European Union via DHL.

LA VEE hats are made to order and are generally ready to ship within 14 days. Faster service is available upon request and subject to an additional €50 service charge.

Payments made via the credit card form are handled by the payment service provider Stripe, Inc., 510 Townsend Street, San Francisco, CA 94103, USA, under the terms and conditions of Stripe, to be found here

8. Retention of Title

Title to the goods shall remain vested in LA VEE until full payment has been received.

9. Guarantees for Faulty Goods

The statutory guarantees for faulty goods apply.

In case of a damaged shipment, we kindly ask the customers to submit a claim to the shipment provider (i.e. DHL) and also to notify us of the issue. Failing to do so does not affect your statutory and contractual guarantees for faulty goods.
